France
 
France has a lower poverty rate than the EU average. The proportion of poor households is 11% versus the EU's 12%. In terms of child poverty, the numbers are equally striking: in France 7% of children under age 16 live in households below the poverty line, whereas the EU average is 14%. Family policy in France – substantial family allowance benefits and a high employment rate for those women who are the sole income earners in single-parent families.

The right to housing was incorporated into law in 1982 for the first time. On 6 July 1989, the right to housing was permanently adopted in a legal context. The Besson law (31 July 1990) is designed to implement this right and was followed by several measures to make this law effective for low-income persons, and give them access to this fundamental right. A decree as recent as January 2002, defines the standards of ‘decent housing’.

Nevertheless, although the right to housing is recognised by the law, it is only applicable for tenants who have new guarantees in their rental contract as defined according to the 1989 law. This right remains solely a formal and unobtainable right for those who do not have the status of tenant, for those who do not have access to housing and for those who – following a non-executed decision of eviction – stay in accommodation without rights or title. Thus, the right to housing should be considered as a reinforcement of tenants’ rights, rather than as a right to access to housing. France launched a comprehensive strategy against exclusion based on the law of 29 July 1998 and an action programme based on a law passed on 4 March 1998 for a 3-year period. The National Action Plan against poverty and social exclusion is a new step and will be used until 2003 to improve the access to fundamental rights for all. In spite of improvements that could be seen following the 1998 law, the access of vulnerable persons to their rights is still quite rare.

Insee, the French National Statistical Agency, conducted a study on persons without housing in January 2002. This study confirmed that more than 200 000 persons are homeless in France and assumes that between 5.000 and 10.000 persons who live in squats or have no contact with reception centres should be added to this total.
